The Senate acquitted Trump this past Wednesday, but the impact of the impeachment trial is just getting started.

Harvard Law Professor Alan Dershowitz caused the ire of Democrats for his defense of the President during the trial. Senate Minority Leader Schumer rebuked Dershowitz, claiming that Dershowitz would have argued against impeaching former President Nixon.

Dershowitz joined The Cats Roundtable this Sunday and rejected Schumer’s criticism, saying that he believes Schumer and Pelosi “have to go.” He believed Schumer’s comments enforce the idea that Democrats “are prepared to lie for partisan advantage.”

“Lies are becoming so common in the American political scene,” he said.

Even with Trump’s acquittal, House Democrats, such as Adam Schiff and Jerrold Nadler, have spoken with reporters about subpoenaing more witnesses. Though double jeopardy does not technically apply to the impeachment process, Dershowitz said it “certainly should,” adding that Democrats are pulling at straws, as it’s not the choice of witnesses to testify about national security or privileged information.

This Friday following Trump’s acquittal, a D.C. appellate court dismissed a lawsuit by Democratic lawmakers that alleged Trump broke a constitutional clause, barring presidents from receiving money from foreign governments, called emoluments. Dershowitz called it “a ridiculous case in the first place,” adding that it was “contrived” and “frivolous.” He added that the impeachment trial and the attempts of Democratic lawmakers to undermine Trump will reflect poorly on the American people.

The real chance for Democrats to set the record straight is with the 2020 presidential elections, but Dershowitz criticized the primary process for favoring progressive candidates. With South Bend, Indiana Mayor Pete Buttigieg and Senator Bernie Sanders claiming victory in the Democratic primary in Iowa, Dershowitz isn’t any more optimistic.

He believes primary results have proven that more moderate Democrats at one time or another are being carried along as progressive wings in the party to drive the conversation. “Democrats shoot themselves in the foot,” he said. “If they want to win, they have to move to the center.”

He told The Cats Roundtable that Democrats have to choose a candidate “who represents the mainstream” of the Democratic party such as Mike Bloomberg, Amy Klobuchar, or Joe Biden. With Bloomberg’s late arrival in the primary race, Dershowitz believes that if the Democratic Convention is deadlocked, then convention delegates could rally to choose a moderate candidate, but added that he doesn’t think Bloomberg “will win enough delegates to get the nomination.”

He reiterated the importance of the upcoming presidential elections, and the importance of the acquittal of the President in a trial many have said was an attempt to usurp the choice from the American people.

“The Constitution won, the American people won,” Dershowitz said about the impeachment, adding that presidents shouldn’t be chosen or disposed of “in the halls of Congress.”

“Presidents should be voted for and against in the ballot box,” Dershowitz said. “Our system works—and let’s keep it working.”
